Mr. Harper was working on the grounds of a local cemetery when he slipped and fell on ice injuring his back. A few days later he attempted to lift a heavy casket and injured his back again. Mr. Harper sought treatment from his general practitioner who advised him to stay out of work. He also followed up with an orthopedic surgeon for the ongoing pain in his back. An MRI revealed a large herniated disc L4-5 which compressed on the left nerve root. Mr. Harper started a course of physical therapy with little results.

Mr. Harper applied for and was awarded Social Security disability benefits.
